These Terms & Conditions ("Terms") govern reservations and stays at Kihei Beach Condominiums, located at 36 South Kihei Road, Kihei, HI 96753 ("the Property," "we," "us," or "our"). By requesting or confirming a reservation, the guest ("you") agrees to these Terms. Please read them carefully. These Terms are provided as general booking conditions and may be supplemented by the specific terms stated in your reservation confirmation.
1. Reservations
All reservations are subject to availability and written confirmation. A reservation is considered confirmed only once we have accepted your booking request and received the required payment described below. The guest named on the reservation must be at least 25 years of age, must be an occupant of the unit for the entire stay, and may be asked to present a valid government-issued photo ID at check-in. You are responsible for verifying that all details in your confirmation — dates, unit type, rate, guest count, and fees — are accurate.
2. Rates, Taxes & Fees
Quoted nightly and monthly rates are in U.S. dollars and are subject to seasonal variation based on your arrival and departure dates. Rates may change without notice until a reservation is confirmed. The following charges apply as itemized in your booking summary:
- Accommodation charge — the nightly or monthly rate multiplied by the length of stay.
- Cleaning fee — a one-time departure cleaning fee applied per stay.
- Hawaii taxes — all stays of fewer than 180 consecutive days are subject to Hawaii General Excise Tax (GET) and Transient Accommodations Tax (TAT). For 2026 this combines to approximately 18.712% (4.712% GET + 11% State TAT + 3% Maui County TAT), applied to the accommodation charge and cleaning fee.
3. Payments & Deposits
We accept payment by credit/debit card through our secure third-party payment processor and by Bitcoin. Card details are entered directly with the payment processor and are never stored on our website. A deposit may be required to confirm your reservation, with the remaining balance due prior to arrival (typically 60 days before check-in, or in full at the time of booking for near-term stays). Failure to pay the balance by the due date may result in cancellation of the reservation and forfeiture of the deposit.
4. Check-In
Standard check-in time is 3:00 PM Hawaii Standard Time. Early check-in is not guaranteed and must be arranged in advance, subject to housekeeping schedules. Check-in instructions and access details are provided prior to arrival.
5. Check-Out
Standard check-out time is 10:00 AM Hawaii Standard Time. Late check-out must be requested and approved in advance and may incur an additional fee. Before departure, guests are asked to secure the unit, dispose of trash, start the dishwasher, and return any borrowed beach gear.
6. Minimum Stay
A minimum length of stay may apply and varies by season. Extended minimum stays (for example, 7–10 nights) typically apply during holiday periods such as Christmas and New Year. Any applicable minimum stay will be shown at the time of booking.
7. Occupancy
Maximum occupancy is limited to the number of guests stated in your confirmation (generally up to 4 guests for one-bedroom units and up to 6 guests for two-bedroom units), including children. Exceeding the stated occupancy, or using the unit for events, parties, or commercial filming, is prohibited and may result in immediate termination of the stay without refund. The Property is a private residential condominium, not a hotel.
8. Cancellation Policy
Cancellation terms are confirmed at the time of booking and may vary by season and rate. Unless otherwise stated in your confirmation, the following general schedule applies:
- 60 or more days before arrival: refund of amounts paid, less any non-refundable booking/processing fee.
- 30–59 days before arrival: refund of 50% of the accommodation charge.
- Fewer than 30 days before arrival: no refund; the full reservation amount is due.
No-shows and early departures are not refundable. We strongly recommend purchasing travel insurance to protect against unforeseen circumstances. Bitcoin payments are non-reversible; any approved refund of a Bitcoin payment will be issued in U.S. dollars.
9. House Rules
All guests must comply with the Kihei Beach Association of Apartment Owners (AOAO) House Rules, which are posted in the unit and the building. In summary:
- Observe quiet hours (generally 10:00 PM to 8:00 AM). Kihei Beach is a residential community — please be considerate of neighbors.
- Use of the pool, barbecue, laundry, and other common areas is at your own risk and subject to posted rules and hours.
- Lock doors and windows and secure the lanai when the unit is unattended.
- Parking is limited to designated stalls; register your vehicle as instructed.
- No illegal activity, no commercial use, and no disturbance of other residents or guests.
10. Smoking Policy
The Property is 100% non-smoking, including all units, lanais, and common areas, in accordance with Hawaii law and AOAO rules. This applies to cigarettes, cigars, vaping, and cannabis. Evidence of smoking will result in a deep-cleaning charge (typically $300 or more) plus any additional remediation costs.
11. Pet Policy
Pets are not permitted. Trained service animals as defined by the Americans with Disabilities Act are welcome in accordance with applicable law; please notify us in advance. Unauthorized animals may result in additional cleaning charges and termination of the stay.
12. Liability & Assumption of Risk
To the fullest extent permitted by law, the Property owner, manager, and AOAO are not liable for any injury, illness, loss, or damage to persons or personal property arising from your stay or from use of the beach, ocean, pool, or common areas, except where caused by our gross negligence or willful misconduct. Ocean and beach activities carry inherent risks; guests participate at their own risk. You are responsible for the conduct of everyone in your party and for any loss or damage to the unit or its contents during your stay beyond normal wear and tear.
13. Damage & Care of the Unit
Please treat the unit with care. You agree to report any pre-existing damage promptly and to reimburse the Property for damage, excessive cleaning, or missing items resulting from your stay. We may require a refundable security deposit or a damage-protection arrangement disclosed at booking.
14. Force Majeure
We are not responsible for failure to perform due to events beyond our reasonable control, including natural disasters, severe weather, government action, utility failures, or other emergencies. In such cases we will work with you in good faith regarding rescheduling or refunds where appropriate.
15. Governing Law
These Terms are governed by the laws of the State of Hawaii, without regard to conflict-of-law principles. Any dispute shall be resolved in the state or federal courts located in Maui County, Hawaii.
